Terms of Service

1. Who we are and what this covers

XRosk is operated by XRternal Operators, LLC ("we", "us"), a Wyoming limited liability company with its registered address at 30 N Gould St, Suite R, Sheridan, WY 82801. These terms apply to the XRosk website, portal, display software, and related services, together the "Service".

By creating an account or using the Service you agree to these terms. If you're agreeing on behalf of an organization, you confirm you're authorized to do so.

Subject to your compliance with these terms, we grant you a non-exclusive, non-transferable, non-sublicensable, limited license to access and use the Service while your account and plan remain active and in good standing. The Service itself — including its software, design, and content — remains ours; these terms give you a right to use it, not ownership of it.

2. Displays, headsets, and third-party services

XRosk lets you show a compatible XR headset on a connected display and choose what that display shows when live casting is unavailable. Current hardware and software requirements are listed on our website or in the portal and may change as the Service develops.

Hardware is bring-your-own unless we agree otherwise in writing. You are responsible for obtaining, installing, securing, powering, and maintaining compatible display hardware, headsets, networks, cables, and any other equipment needed to use the Service. We do not warrant third-party hardware or its suitability for your environment.

Some casting methods depend on third-party services — currently ArborXR — under an account you control. We are not affiliated with, endorsed by, or acting on behalf of ArborXR. You are responsible for having the right to connect that account and the assigned headsets. Availability, latency, and image quality may be affected by the third-party service, your local network, the headset, and the display hardware, and we can't guarantee otherwise.

Where the Service offers a direct local-network casting method, you are responsible for enabling and securing the required headset access and network connection. Do not expose debugging or device-control interfaces to networks or people that shouldn't have access.

3. Your account and content

You're responsible for the security of your account credentials and for activity that happens under your account. Tell us promptly if you believe an account, connected service, headset, or display has been compromised.

If you create or invite users under your organization's account, each of them is bound by these terms, and your organization is responsible for making sure they follow them. What a user does in the Service is treated as done by your organization.

You keep ownership of videos, images, names, and other content you upload or enter. You give us a limited license to host, copy, process, and deliver that content only as needed to provide, secure, and support the Service. You confirm that you have the rights and permissions needed to use that content on your displays.

You must be able to form a binding contract to use the Service. The Service is intended for organizational use, not for personal consumer use.

4. Free trial, plans, and billing

A new organization can use one display for a free trial that includes 60 cumulative minutes of live casting. This is a usage allowance, not a wall-clock deadline: setup, idle time, waiting screens, and fallback media do not use trial minutes. Usage is counted only while the display reports that it is rendering live headset frames. The allowance is shared across the organization and does not reset if a display is removed, replaced, or paired again.

Paid subscriptions are billed annually in advance at $49 per active display per year. Each active display requires a paid seat. The current price and included features are also shown on the pricing page and during checkout.

Payments are processed by Stripe. We don't receive or store your full card details.

  • Paid subscriptions renew automatically each year unless cancelled before the renewal date.
  • If you add or remove display seats, Stripe may prorate the resulting charge or credit under the terms shown in the billing portal.
  • Cancelling stops future renewals. We don't provide pro-rata refunds for a partial year unless required by law.
  • We may change prices, with notice before your next renewal. Continuing to use a paid plan after that is acceptance of the new price.

If a paid subscription ends, casting access returns to the organization's remaining free-trial allowance, if any. An exhausted trial does not restart when a subscription ends.

The free trial is provided as-is and at no charge. We may change or withdraw it, but we will not shorten casting time an organization has already earned through the stated trial offer without reasonable notice.

5. Service data and privacy

We process account, display, casting-configuration, uploaded-media, operational, trial-usage, and billing information to provide the Service. Our Privacy Policy describes what we collect, where it comes from, and how we use and retain it.

Live headset video is used to render the cast on your display. The Service does not record or store the live video stream as a recording. Uploaded fallback videos and images are separate: we store them so your chosen displays can download and show them when live casting is unavailable.

We may use aggregated, de-identified information to operate and improve the Service. Aggregated and de-identified means the information does not identify you, your organization, your users, or your individual devices and cannot reasonably be used to do so. We do not sell your data.

6. Acceptable use

You agree not to:

  • Access or cast from headsets, accounts, displays, networks, or content you aren't authorized to use.
  • Attempt to circumvent trial limits, display-seat limits, billing, pairing, or access controls.
  • Interfere with the Service or use it in a way that degrades it for others or places unreasonable load on our systems or a third-party casting service.
  • Upload unlawful, infringing, malicious, or harmful content.
  • Use the Service for surveillance, covert recording, or another purpose that violates privacy or other applicable law.
  • Resell or provide the Service to third parties without our written agreement.
  • Reverse engineer the Service except where that right can't be excluded by law.

7. Availability and warranties

We work to keep the Service available and reliable, but we provide it "as is" without warranties of any kind, to the extent permitted by law. We don't warrant that it will be uninterrupted or error-free, that every headset or network will cast successfully, or that a third-party service will remain available or compatible.

The Service is a display and casting aid, not a safety system. Don't rely on it as the sole control, supervision, or communication method for anything where failure would cause harm, loss, or significant cost. This is especially important in public kiosks, demonstrations, conferences, and training environments.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses, or for lost profits, revenue, data, content, business opportunity, or damage to third-party hardware.

Our total liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. For free-trial use, that amount is zero. Please understand this consequence before relying on the free trial.

Nothing here limits liability that cannot lawfully be limited.

9. Termination

You can stop using the Service, cancel future subscription renewals, and request account deletion at any time. We may suspend or terminate an account that breaches these terms, creates a security risk, or must be restricted by law, and we'll give notice where it's reasonable to do so.

On termination we'll delete or de-identify your data within a reasonable period, except where we're required to retain it, need it to resolve a billing or security issue, or it has already been aggregated and de-identified. You should retrieve any content you need before termination.

10. Changes to the Service and these terms

The Service will change over time. We may add, improve, or retire features and supported hardware, casting methods, or third-party integrations. If a change removes something material from a plan you're paying for, we'll give notice.

We may update these terms. If a change materially affects your rights, we'll give notice by email or in the portal before it takes effect. Continuing to use the Service after that means you accept the updated terms.

We will not retroactively broaden how we use data you've already given us without asking you first.

11. Governing law and disputes

These terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules.

The state and federal courts located in Wyoming have exclusive jurisdiction over any such dispute, and each of us consents to their jurisdiction. Before filing a claim, we each agree to try to resolve the dispute informally by contacting the other first.

12. General

Assignment. You may not assign or transfer these terms or your account without our written consent. We may assign these terms in connection with a merger, acquisition, sale of the business, or corporate reorganization; your rights under them are unaffected, and we'll give notice.

Severability. If any part of these terms is found unenforceable, that part is limited or removed to the minimum extent necessary, and the rest remains in force.

Entire agreement. These terms, together with our Privacy Policy and the plan details you accept in the portal, are the entire agreement between us about the Service, and replace any earlier discussions or representations.

No waiver. If we don't enforce a part of these terms right away, we haven't given it up — we can still enforce it later.

Force majeure. Neither of us is liable for delay or failure caused by events beyond reasonable control, such as upstream outages, network failures, natural disasters, or government action. Payment obligations aren't excused by this.

Indemnification. You'll defend us against third-party claims, and cover the resulting costs, where the claim arises from your breach of these terms, your content, or your use of hardware, headsets, accounts, credentials, or networks you weren't authorized to use.

Notices. We send official notices to the email address on your account, and they count as given when sent. You can send notices to us at hello@xrosk.app or by mail to our registered address in section 1.
